These terms of use (hereinafter referred to as these “Terms”) apply to all relationships between users of “JFF Theater” (hereinafter referred to as “this Site” or “our Site”) operated by the Japan Foundation (hereinafter referred to as the “Foundation”, “we”, “us” or “our”) and users (hereinafter referred to as “Users”, “you” or “your”) and users who have registered to use this Site (hereinafter referred to as “Registered Users”) when using this Site. Please read these Terms carefully to the end before using our Site.

Article 1. Application

In order to use this Site, Users must agree to these Terms. The separately specified “Cookie Policy” is also a part of these Terms. By agreeing to these Terms, you also agree to the “Cookie Policy.”

Article 2. Services Provided

  • 1.

    This Site (www.jff.jpf.go.jp) is operated by the Foundation with the purpose of distributing Japanese films and content related to Japanese films (including but not limited to logos, visual content, images or videos, audio, music, and video works in whole or in part; the same applies hereinafter) to people overseas. We provide articles and event information related to Japanese films in multiple languages.

  • 2.

    Registered Users can watch videos that the Foundation distributes in streaming format on this Site. In addition, by following the designated procedures when registering as a user, Users can receive newsletters containing the latest information about this Site and email notifications from our overseas offices.

  • 3.

    Users may view some of the videos which we distribute in streaming format on this Site. Users who wish to view more videos must become a Registered User.

Article 3. User Registration

  • 1.

    Users who wish to become a Registered User must complete the user registration in the manner specified by us. User registration requires the registration of (1) email address, (2) username, (3) password, and (4) country/region of residence. To receive the newsletter, you must indicate that you wish to receive the newsletter when registering to become a User to watch videos on this Site or by registering your email address using the newsletter reception form available on this Site. To receive notification emails from our overseas offices, you must select the overseas office from which you wish to receive emails when registering to become a User.

  • 2.

    When registering to become a User, you must confirm and declare that your age is 18 years old or older and are fully competent and able to agree to and abide by the terms, conditions, obligations, representations and warranties set forth in these Terms. If the User does not meet the above conditions, the User confirms and guarantees that they have parental or guardian permission to create an account.

  • 3.

    When a notice on this Site showing the completion of user registration is displayed, the User will be qualified as a Registered User. Registered Users can save their own desired password, but the password must be comprised of a character string that is difficult for a third party to guess.

  • 4.

    Registered Users must strictly manage their email addresses and passwords (hereinafter, referred to collectively as "User Accounts") and must not disclose, lend, or transfer them to third parties. In addition, they must not allow third parties to use their User Accounts.

  • 5.

    When the User Account information entered when using this Site matches the Registered User Account, we will deem that such use is by the Registered User associated with such User Account.

  • 6.

    Registered Users shall be liable for any damages arising from insufficient management or negligence in the use of their User Accounts.

  • 7.

    If a Registered User forgets their User Account or becomes aware that it is being used by a third party, they shall immediately take steps to reset their User Account using the methods specified by the Foundation.

  • 8.

    If there are any changes to the information provided to us at the time of user registration, the Registered User must notify us without delay in the manner we specify. The Foundation shall not be liable for any damages or other disadvantages suffered by the Registered User arising from the failure to notify.

Article 4. Cancellation of User Registration

  • 1.

    The validity period of a User Account shall be indefinite unless otherwise specified by the Registered User or the Foundation. A Registered User who wishes to delete their user registration or withdraw from the Site may discontinue use of the Site through the account management screen.

  • 2.

    If a Registered User who has completed the procedure for deleting their user registration incurs damages to the Foundation or a third party resulting from their actions, they shall bear all legal responsibility even after they have lost their registered user status and shall indemnify the Foundation from any liability, except in cases where the Foundation is found to have acted intentionally or grossly negligently. However, if the usage agreement for this Site (hereinafter referred to as this “Agreement”) constitutes a consumer contract as defined in the Consumer Contract Act, the Foundation shall only compensate the Registered User for ordinary damages directly and actually incurred, except in cases where the Foundation is found to have acted intentionally or grossly negligently.

  • 3.

    If a Registered User violates any provision of these Terms or any laws and regulations, particularly if the Registered User infringes any intellectual property right, including copyright, or any individual right to privacy, we may delete the Registered User’s account and suspend the Registered User’s use of this Site without notifying the Registered User.

Article 5. Prohibited Activity

1. When using this Site or any of the services on this Site, Users are prohibited from engaging in any of the following acts:

    • (1)

      Any acts that may cause damage to the Foundation or a third party, such as hacking, sending viruses, or sending spam mail;

    • (2)

      Any illegal modification or alteration of the programs, software products, etc., on this Site;

    • (3)

      Any act that violates or may violate laws and regulations;

    • (4)

      Any act that is contrary to public order and morals or that may be contrary to public order and morals;

    • (5)

      Sending false information;

    • (6)

      Any act that may cause damage to the Foundation;

    • (7)

      Any act that interferes with the operation of this Site or any of the services on this Site; and

    • (8)

      Any other conduct that the Foundation deems inappropriate

  • 2.

    Any act of directly or indirectly infringing the copyright or other rights of the Foundation or a third party, including copying, reproduction, transmission, reprinting, distribution, sale, licensing, etc., of films or content of this Site (including images, logos, trademarks, audiovisual content, music, etc., in whole or in part), is strictly prohibited.

  • 3.

    If a User violates the provisions in the preceding two paragraphs and infringes any intellectual property right, including copyright, an individual’s right to privacy, or any other right belonging to the Foundation or a third party, the User agrees to indemnify the Foundation or any third party against all claims, damages, obligations, losses, liabilities, costs and expenses (including, but not limited to, attorney’s fees) incurred by the Foundation or such third party.

  • 4.

    Registered Users may not transfer, lend, change the name of, buy, or sell their User Accounts to third parties. Furthermore, Registered Users may not allow third parties to use their User Accounts.

  • 5.

    The Foundation shall not be liable for any damage suffered by a Registered User as a result of a third party using the User Account held by the Registered User unless the Foundation is found to have acted intentionally or with gross negligence. Registered Users shall be obligated to compensate the Foundation or third parties for any damage suffered by the Foundation or third parties arising from the use of their User Account by a third party.

Article 6. Precautions for Viewing Videos

  • 1.

    The right to use the content of this Site (such as logos, visual content, images or videos, audio, music, and video works in whole or in excerpts) belongs to the Foundation, without prejudice to the rights of the copyrights and other intellectual property rights holders.

  • 2.

    Registered Users can watch movies by streaming them on this Site.

  • 3.

    Unless permitted by the Foundation, any use of the films distributed on this Site for anything other than personal, non-commercial viewing is strictly prohibited. All content on this Site is also subject to copyright protection.

  • 4.

    Regarding the ethical review of films distributed on this Site, the regulations in Japan will be used as the standard. In particular, for films with age restrictions set for the purpose of protecting minors, the restriction category will be clearly stated on the introduction page of each film.

  • 5.

    The Foundation reserves the right to restrict access to the films distributed on this Site from countries and regions not covered by the distribution. This is due to the legal status of the film, and if the film is accessed from such a country or region, a system will be activated to prevent viewing.

  • 6.

    We will ask Users to fill out a survey to assist future business operations. The information provided in the survey will be managed separately from information about User Accounts.

Article 7. Suspension of Site Provision

If the Foundation determines that any of the following events occur, it may suspend or interrupt the provision of all or part of this Site without prior notice to the User. The Foundation shall not be liable for any disadvantage or damage suffered by the User or a third party due to the suspension or interruption of the provision of this Site, regardless of the reason, except in cases where the Foundation is found to have acted intentionally or grossly negligently. However, if this Agreement constitutes a consumer contract as defined by the Consumer Contract Act, the Foundation shall only compensate the Registered User for ordinary damages directly and actually incurred, except in cases where the Foundation is found to have acted intentionally or grossly negligently.

    • (1)

      When carrying out maintenance, inspection, or updating of the computer system related to this Site;

    • (2)

      If it becomes difficult to provide the Site due to force majeure such as an earthquake, lightning, fire, power outage, or natural disaster;

    • (3)

      When a computer or communication line, etc. is stopped due to an accident; and

    • (4)

      Any other case in which the Foundation determines it is difficult to provide the Site.

Article 8. Responsibility for Communication and Packet Fees Related to Site Viewing

The services of this Site are provided to Users via the internet. Users must properly install and operate all equipment, communication means, software, etc., required to use this Site and its services at their own responsibility and expense. Users must also be aware in advance that communication fees, packet communication fees, etc., may be incurred when connecting to this Site. All such communication fees, etc., shall be borne by the Users.

Article 9. Disclaimer

  • 1.

    The Foundation will endeavor to ensure that all information provided on this Site is accurate and up-to-date at all times. However, the Foundation shall not be liable for any situation arising from the content of this Site, except in cases where the Foundation is found to have acted intentionally or grossly negligently.

  • 2.

    The Foundation will take all possible security measures to ensure that all information, databases, articles, images, files, linked websites, etc., on this Site are free of viruses or other harmful substances and to prevent unauthorized access from third parties. However, in the unlikely event that damages occur due to infection or unauthorized access, etc., the Foundation will not be liable for such damages unless the Foundation is found to have acted intentionally or grossly negligently.

  • 3.

    Notwithstanding the provisions of the preceding paragraphs, the Foundation shall not be liable for any damages incurred by the User with the use of this service, unless the Foundation is found to have acted intentionally or grossly negligently. However, if this Agreement constitutes a consumer contract as defined in the Consumer Contract Act, the Foundation shall only compensate the Registered User for ordinary damages directly and actually incurred, unless the Foundation is found to have acted intentionally or grossly negligently.

Article 10. Links from this Site

This Site contains links to websites owned and operated by third parties, but we make no guarantees regarding the content provided by the linked sites, and we take no responsibility for them. Please use the linked sites in accordance with their terms of use.

Article 11. Links to this Site

If a website or other resource provided by a third party provides a link to this Site, the Foundation does not manage those websites or resources and therefore cannot assume any responsibility. There is no need for individuals, organizations, or entities, whether commercial or non-commercial, to contact us to include a link in their website to the top page of this Site. However, links are not permitted in the following cases:

    • (1)

      Websites containing content that violates public order and morals;

    • (2)

      Websites that contain content that is criminal or that may be linked to criminal activities or that may be otherwise illegal or that may be linked to illegal activities;

    • (3)

      Websites that cause harm to or defames the Foundation or third parties;

    • (4)

      Websites that use the assets of the Foundation (logos, characters, etc.) without the permission of the Foundation;

    • (5)

      Websites that may give the false impression that they have some kind of partnership or cooperative relationship with the Foundation;

    • (6)

      Websites that may damage the reputation or credibility of the Foundation;

    • (7)

      Websites that use or provide harmful programs such as computer viruses, or conduct acts which may cause the foregoing;

    • (8)

      If a false declaration or notification is made, such as registering another person's email address; and

    • (9)

      Any other case that the Foundation deems inappropriate.

Article 12. Basic Policy on Privacy

We collect user information according to the services we provide on this Site. We handle the collected information appropriately as follows. For more information, please refer to our Cookie Policy.

  • (1) Scope of information to be collected and purpose of use
    • A.

      This Site automatically collects information such as internet domain names and IP addresses. We also use cookies to automatically collect information about visits to this Site. This information is used for the information provision service on this Site and as a reference for the Foundation’s business operations. This Site also uses “Google Analytics” to understand how you use this Site.     • B.

      To receive the newsletter, you will be asked to register your email address. You can unsubscribe from the newsletter or change or correct your information at any time.

    • C.

      To view streaming content, you will be required to register a user ID, email address, and password. This information will be used to contact you and verify your identity in relation to viewing content.

    • D.

      When conducting surveys on this Site, we may ask you to fill in information such as your attributes, your thoughts on movies or events you have watched, your past history of watching Japanese movies, etc. This information will be used as a reference for the Foundation’s business operations.

    • E.

      When you contact us about this Site, we may collect your name and other information that constitutes personal information.

    • F.

      In addition, the Foundation may use non-personally identifiable information collected from Users for marketing purposes and provide it to third parties.

  • (2) Restrictions on use and provision
    • We will never intentionally disclose to a third party any information collected from Users which may identify the individual (hereinafter referred to as “Personal Information”), except in the following three exceptional cases or when permitted by law:
    • 1.

      When required by law;

    • 2.

      When consent has been obtained from the person providing the information, particularly regarding disclosure to a third party; and

    • 3.

      When entrusting a contractor with the processing of collected information, disclosure is made to the extent necessary for the performance of said work.

Article 13. Security

We take appropriate and reasonable measures to prevent the unintentional disclosure or leakage of information collected from Users to third parties, or its loss or damages. However, please note that even if the security measures taken by the Foundation are legally sufficient, they do not completely guarantee security.

Article 14. Changes to these Terms

  • 1.

    We may update these Terms in the following cases:

    • (1)

      To reflect changes to the services provided on this Site;

    • (2)

      For legal, regulatory, or security reasons; and

    • (3)

      To prevent fraudulent or dangerous activities.

  • 2.

    We will notify Users of any major changes to these Terms at least 30 days in advance, and any minor changes at least one week in advance, on the Site to provide Users with an opportunity to review the significant changes. However, this does not include (i) cases where new services or new functions are added, and (ii) cases of emergency (such as when it is necessary to stop ongoing fraudulent activity or respond to legal requirements). If Users do not agree to the new terms, they should delete their account and stop using the services.

Article 15. Notice to Users

  • 1.

    Any notice from the Foundation to the User will be given by a method that the Foundation deems appropriate, such as by posting on this Site or by email.

  • 2.

    In the case where the Foundation notifies the User by posting on this Site or by email pursuant to the provisions of the preceding paragraph, such notice shall take effect from the time it is posted on this Site or the email is sent. The Foundation shall not be held responsible in any way if the User is unable to view the posting or receive the email due to their settings.

  • 3.

    The User shall be obligated to check any notices from the Foundation to the User at any time, and the Foundation shall not be liable for any damages incurred by the User as a result of the User’s failure to do so unless the Foundation is found to have acted intentionally or grossly negligent. However, if this Agreement constitutes a consumer contract as defined in the Consumer Contract Act, the Foundation shall only compensate the Registered User for ordinary damages directly and actually incurred, unless the Foundation is found to have acted intentionally or grossly negligent.

Article 16. Governing Law and Jurisdiction

The governing law of these Terms shall be the laws of Japan, and any disputes arising between the Foundation and Users based on or in connection with these Terms or this Site shall be submitted to the Tokyo District Court as the court of first instance with exclusive jurisdiction. Translations of these Terms and the guidelines on this Site (hereinafter collectively referred to as these “Terms, etc.”) into other languages are provided by the Foundation solely for the convenience of Users, and Users agree in advance that the Japanese version of these Terms, etc. shall apply to all relationships between the Foundation and Users.
